### I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts that you conclude with us as the provider (Phuc Le Huynh Gia) via the website [https://eclipsestudiios.com](https://eclipsestudiios.com). Unless otherwise agreed, the inclusion of any of your own terms that may apply is objected to.

(2) A consumer in the sense of the following regulations is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or a partnership with legal capacity who acts in the exercise of their trade, business, or self-employed professional activity when concluding a legal transaction.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By listing the respective product on our website, we provide you with a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the item description.

(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "shopping cart." You can access the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time.
After selecting the "Checkout" or "Proceed to Order" button (or similar label) and entering your personal data and payment and shipping conditions, the order data will be displayed as an order overview.

If you use an instant payment system (e.g., PayPal, Amazon Pay, Sofort, giropay), you will either be redirected to the order overview page in our online shop or to the website of the instant payment system provider.
If you are redirected to the respective instant payment system, you will need to make the appropriate selection or enter your details there. The order data will then be displayed as an order overview on the instant payment provider's website or after being redirected back to our online shop.

Before submitting the order, you can review, modify (also via the "back" function of the internet browser), or cancel the order.

By submitting the order via the corresponding button ("order with obligation to pay," "buy now," or similar label), you declare the acceptance of the offer in a legally binding manner, and the contract is thereby concluded.

(4) Your inquiries regarding the preparation of an offer are non-binding. We will provide you with a binding offer in text form (e.g., via email), which you can accept within 5 days (unless a different deadline is specified in the respective offer).

(5) The processing of the order and transmission of all necessary information in connection with the conclusion of the contract will be carried out via email, partly automated. Therefore, you must ensure that the email address you have provided to us is correct, and that the receipt of emails is technically ensured and not blocked by spam filters.

§ 3 Individually Designed Goods

(1) You provide us with the appropriate information, texts, or files necessary for the individual design of the goods via the online ordering system or by email without undue delay after the conclusion of the contract. Our specifications for file formats must be observed.

(2) You undertake not to transmit any data whose content infringes the rights of third parties (in particular, copyrights, name rights, trademark rights) or violates existing laws. You expressly release us from all claims made by third parties in this context. This also applies to the costs of the necessary legal defense in this context.

(3) We do not review the transmitted data for its content and assume no liability for errors.

§ 4 Special Arrangements for Payment Methods Offered

(1) **Payment via "PayPal" / "PayPal Checkout"**  
When selecting a payment method offered via "PayPal" / "PayPal Checkout," payment processing is carried out via PayPal (Europe) S.à.r.l. et Cie, S.C.A. § 5 Right of Retention, Retention of Title

(1) You can only exercise a right of retention insofar as it concerns claims from the same contractual relationship.

(2) The goods remain our property until the purchase price is paid in full.

§ 6 Warranty

(1) Statutory liability for defects applies.

(2) As a consumer, you are requested to check the goods upon delivery for completeness, obvious defects, and transport damage and to notify us and the carrier of any complaints as soon as possible. Failure to do so has no effect on your statutory warranty claims.

(3) If a characteristic of the goods deviates from the objective requirements, this deviation is only deemed to be agreed upon if you were informed of it before submitting the contractual statement and the deviation was expressly and separately agreed upon between the contracting parties.

§ 7 Choice of Law

(1) German law applies. For consumers, this choice of law applies only to the extent that the protection provided by mandatory provisions of the law of the country of the consumer's habitual residence is not withdrawn (favorability principle).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods explicitly do not apply.

3. Contract Language, Storage of Contract Text

   3.1. The contract language is German.

   3.2. We do not store the full contract text. Before submitting the order via the online shopping cart system, you can print or save the contract data electronically using the browser’s print function. After receiving your order, the order data, legally required information for distance contracts, and the General Terms and Conditions will be sent to you again by email.

   3.3. For inquiries outside the online shopping cart system, you will receive all contract data as part of a binding offer in text form, such as by email, which you can print or save electronically.

4. Essential Characteristics of the Goods or Services

The essential characteristics of the goods or services are provided in the respective offer.

5. Prices and Payment Terms

   5.1. The prices listed in each offer and shipping costs represent total prices, including all price components, including taxes.

   5.2. Shipping costs are not included in the purchase price. They are accessible via a correspondingly labeled button on our website or in the respective offer, displayed separately during the order process, and must be borne by you unless free shipping is promised.

   5.3. If delivery is made to countries outside the European Union, additional costs may arise that we are not responsible for, such as customs duties, taxes, or money transfer fees (transfer or exchange rate fees of the credit institutions), which you must bear.
